GENERAL TERMS AND CONDITIONS FOR ONLINE SALES

Welcome to www.lamby.fr (the "Website"). Before proceeding with any product purchase, please take a moment to carefully review these General Terms and Conditions of Sale ("GTC").

1. SCOPE OF APPLICATION

1.1. These GTC are applicable to all sales agreements between LÄMBY Paris SARL, headquartered at 27 rue Poissonnière, 75002 Paris (France), and users, defined as consumers in accordance with the Consumer Code. A consumer is an individual who acts for non-commercial, non-industrial, non-craft, non-liberal, or non-agricultural purposes ("User," "you") when placing orders through the Website.

 

1.2. By placing an order for products ("Products") on the Website, you unconditionally accept and agree to abide by these GTC. If you do not agree with these GTC, you will be unable to place an order on the Website.

 

2. CONDITIONS FOR SHOPPING ON THE WEBSITE

 

2.1. Purchases on the Website are exclusively available to end consumers. If you are a professional reseller or distributor, you are not permitted to make purchases through the Website. LÄMBY may limit the quantity of Products that can be purchased by a user to ensure better service quality and availability to all site users.

 

2.2. Purchases on our site are restricted to adults. By accepting these terms and conditions, you confirm that you are at least 18 years old. LÄMBY is not responsible for any misrepresentation of user age.

 

2.3. We reserve the right to cancel or reject orders that appear to be placed by professional resellers or distributors.

 

3. HOW A LÄMBY ORDER WORKS

 

To place an order, select your desired products and add them to your basket either by using the "Add to bag" button or the quick add-to-bag feature.

 

At any point, you can:

 

- Review the number of items in your basket and their prices by clicking the "Bag" icon or "View and modify my bag."

- Continue shopping by clicking "Continue Shopping."

- Finalize your order by clicking "Checkout."

 

Next, provide the delivery address and select a delivery method from those outlined in Article 7.

 

Afterwards, choose a payment method from those listed in Article 5 and indicate the billing address if it differs from the delivery address. You cannot proceed with "Finalize and pay my order" without accepting these GTC by checking the provided box.

 

Throughout these steps, you'll see the details of your basket.

 

The sale contract between LÄMBY and you is formed upon order confirmation.

 

Between the time you pay for your order and LÄMBY sending you the order confirmation email ("Order confirmed"), LÄMBY reserves the right to not accept the order in the event of:

 

- Disputes between us;

- Total or partial non-payment of one or more previous orders;

- Refusal of payment authorization by banking institutions;

- Inventory issues;

- Professional resellers or distributors.

 

Once the order is prepared for shipment, we will send you an order dispatch email.

 

If a product becomes unavailable after the order is placed, you will only be charged for the available products' price and shipping costs. LÄMBY will notify you by email of any unavailable products, and the corresponding amount will be refunded using the same payment method as the order.

 

4. PRICE

 

4.1. Product prices are stated in Euros.

 

4.2. Our prices are displayed inclusive of all taxes (including VAT) for orders shipped to European Union countries. The tax amount varies by country due to different VAT rates. We are required to apply the VAT rate of the destination country, so the final price with VAT may be recalculated based on the delivery country.

 

4.3. As described in 4.3 and 4.4, you will not be responsible for paying taxes or customs duties on orders shipped to Mainland France and European Union countries. Taxes and customs duties apply to the following delivery destinations:

 

- Any country outside the European Union

- Overseas departments/regions and communities (DOM and COM)

 

The total amount is beyond our control, and the recipient is responsible for these costs. If you refuse a parcel due to additional customs duties upon receipt, LÄMBY reserves the right to charge you the original customs duties, up to €25.

 

4.4. Website prices do not include delivery costs, which are borne by the user.

 

4.5. LÄMBY reserves the right to change product prices and alter, limit, or end any special offers, promotions, or discounts at any time.

 

4.6. LÄMBY applies the prices listed on the website at the time of your order. Always verify the price before submitting your order.

 

5. METHODS OF PAYMENT

 

5.1. LÄMBY uses payment service providers to process transactions on the website.

 

Payment for your order can be made using one of the following methods:

 

- Credit card

 

: Visa, Mastercard, Union Pay, JCB, American Express

- PayPal

- Apple Pay

- WeChat Pay

- iDEAL (only available for euro transactions)

- AliPay

- Sofort (available for delivery addresses in Austria, Belgium, Germany, Netherlands, Italy, Poland, Spain, Switzerland)

- Bancontact (available for a delivery address in Belgium)

- Multibanco (available for delivery addresses in Portugal)

- Giropay

 

5.2. Payment must be made at the time of the order.

 

5.3. Payment in four instalments through PayPal is available for orders ranging from €50 to €2,000, following PayPal's terms and conditions. In the event of order cancellation or return, you will receive an automatic refund for the monthly instalments already paid into your bank account.

 

5.4. We use industry-standard Secure Sockets Layer (SSL) technology to encrypt your payment details, including identity, address, and credit card information.

6. CANCELLING AND MODIFYING AN ORDER

 

6.1. When the order status indicates "Payment accepted," you have up to four (4) hours to cancel your order. You can cancel your order directly from the order confirmation page. If your order has a different status or if the four (4) hour deadline has passed, you will be unable to cancel your order.

 

6.2. After our services register the order cancellation and following your bank's standard processing time, please allow at least five (5) working days to receive the refund. If we can only process part of your order, the payment for the entire order will be taken, and a refund for the unavailable items will be issued upon dispatch of the goods.

 

6.3. Once the order is confirmed, it cannot be modified. If you wish to change the order's contents, payment method, or delivery address, you can cancel your order, as explained in 6.1, return the products upon receipt per Article 8, or place a new order on the same day to obtain the desired size or model.

 

7. PRICES AND DELIVERY

 

7.1. Delivery

 

After confirming payment, we process and hand over your order to the carrier within an average of 24 to 48 hours.

 

- Orders placed on Friday or Sunday are processed the following Monday.

- Orders placed on public holidays are processed on the next working day.

 

For pre-ordered products, delivery times are typically longer. Delivery times are specified in the product description on the website.

 

Various delivery methods are available, depending on your delivery country:

 

- La Poste (Colissimo)

- UPS

- Mondial Relay

 

Once your order is transferred to the carrier, you can track your parcel's progress anytime using the tracking number sent via email or your customer account.

 

Upon handover to the carrier, product deliveries are conducted in accordance with the carrier's terms. You will receive email notifications with shipping details, including delivery conditions and estimated delivery date or time.

 

You are responsible for product delivery costs, taxes, and customs duties, as outlined in sections 4.3 and 4.4.

 

Delivery costs and times differ based on order amount, delivery country, and delivery type.

 

7.2. Prices

 

The applicable delivery costs are those displayed on the site at the time of ordering, under "Delivery" and "Return."

 

8. RIGHT OF WITHDRAWAL, RETURNS, AND REFUNDS

 

8.1. As per Article L.221-18 of the French Consumer Code, you have fourteen (14) days from receiving the order to exercise your right to withdraw from LÄMBY without providing any reasons.

 

For orders of multiple products delivered separately, the withdrawal period begins upon receiving the final product.

within a maximum of fourteen (14) days from notifying us of your withdrawal decision.

 

8.2. Beyond your statutory withdrawal right, you have twenty-eight (28) days from the first presentation of the package to return any ordered product that doesn't meet your expectations.

 

After this period, we do not accept returns for unwanted items. Attempting a return may require us to send the item back to you, with you covering the delivery costs.

 

8.3. All returned items must be new, unworn, and unwashed, ideally in their original packaging.

 

Products not meeting these conditions will be returned to you at your expense.

 

LÄMBY covers return costs under these conditions:

 

- In France for orders over €128

- In Europe for orders over €150

 

If your delivery country isn't listed, or if you choose a return method different from LÄMBY's offering, return expenses are at your cost and risk.

 

Countries with free return shipping: Andorra, Austria, Belgium, Croatia, Czech Republic, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Switzerland.

 

8.4. Refunds can be issued in one of two ways:

 

- Bank card recredit, if the payment was made by card

 Credit note (valid for 1 year)

 

Given that the return conditions are met, our processing time is 5 to 10 working days, beginning when we receive the order in our warehouse. This period may be extended based on your bank's processing time or if additional checks are required for the return.

 

Please note:

 

- If the order was paid for with a Credit Note, refunds will be issued in Credit Notes. Credit notes are valid for one year and cannot be refunded.

- Exchanges are not possible. For a new size or different model, please place a new order.

- Products purchased on the Website cannot be returned in physical stores.

10. APPLICABLE LAW AND JURISDICTION

 

These GTC are governed and interpreted under French law, with the user's local law's more protective provisions applied, if applicable. In the event of a dispute, the competent court will be the defendant's place of residence or, at the plaintiff's discretion, the actual product delivery location.

 

11. INTELLECTUAL PROPERTY

 

All website contents, including but not limited to illustrations, photographs, images, text, data, names, trademarks, and videos, are exclusively owned by LÄMBY, its partners, or contractors. These contents are protected by copyright, trademark, foreign copyright laws, and other intellectual property rights.

 

Reproducing this content, in part or in full, by any means, requires prior written consent from LÄMBY. You are not permitted to attach or download content from the website without LÄMBY's written consent.

 

12. GUARANTEE EXCLUSION

 

In accordance with Article 1148 of the French Civil Code, LÄMBY is not liable for delivery delays or damage resulting from force majeure, as determined by French court case law.

 

The website is provided "as is," and LÄMBY reserves the right to change its content without notice.

 

While we make every effort to maintain website accuracy, usability, and completeness, LÄMBY is not responsible for malfunctions due to maintenance work, technical failures, internet network interruptions, force majeure, third-party actions, or any other circumstances.

 

Some jurisdictions do not allow warranty exclusions, so this section may not apply to you.

LÄMBY reserves the right to make GTC changes at any time and without prior notice when necessary to comply with new legal provisions, adapt GTC to LÄMBY's sales processes, or for technical reasons. The GTC in effect at the time of order placement will apply. Updated GTC versions will be published on the Website.
